If you have health coverage through a private sector employer’s plan, there are laws to protect these benefits for you and your family. You probably have heard of some of them, such as COBRA, HIPAA and the Affordable Care Act. Not as well-known are two laws that provide protections if your plan offers mental health and substance use disorder benefits. The Mental Health Parity Act (MHPA) and the Mental Health Parity and Addiction Equity Act (MHPAEA) provide additional protections for employment-based group health plan coverage, including prohibiting plans from charging you more to receive mental health benefits than similar medical or surgical benefits.
