Need to Know: New Maryland Parental Leave Law

Effective October 1, 2014, small employers in Maryland (at least 15 but not more than 49 employees) will be required to provide employees with unpaid leave for the birth or adoption of a child under the Maryland Parental Leave Act (PLA).

The Details

  • Eligibility is similar to the Federal Family Medical Leave Act (FMLA),
  • Employees must have been employed for one year and have worked 1,250 hours.
  • Employees are eligible for six (6) weeks of unpaid leave for the birth or adoption of a child.
  • Like the FMLA, employers are required to maintain the employee’s health coverage for the duration of PLA and restore the employee to the same position that the employee held prior to the leave.
